Terms and Conditions for NavuMilan

Welcome to NavuMilan (the "App" or "Website" or "Platform"). User access to and use of the NavuMilan website ("Site") and its related application ("Applications") as well as the services offered herein, including any membership or subscription services (hereinafter collectively referred to as the "Platform"), are owned and operated by MUKM CENTRE ("NavuMilan") in India.

These Terms and Conditions ("Terms" or "Agreement") constitute a legally binding contract between you (the "User" or "Data Principal") and MUKM CENTRE ("we," "our," or "us"). Please read these Terms carefully before downloading, registering, or using the Platform. By accessing or using the App, you signify your absolute acceptance of and agreement to be bound by these Terms. If you do not agree, you must immediately uninstall and discontinue all use of the Platform.

This Agreement is an electronic record/document in terms of the Information Technology Act, 2000 and rules made thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require any physical, electronic, or digital signatures to be legally binding.

1. Eligibility, Matrimonial Scope & Free Will Consent

• Strict Matrimonial Purpose: NavuMilan is strictly a matrimonial platform designed to facilitate matchmaking for solemnizing legal marriages. It is not a dating app, social networking site, or platform for casual relationships, commercial transactions, or any illicit activities.
• Marriageable Age: By registering on the App, you represent and warrant that you are of legal marriageable age under the laws of India, which is 21 years or older for males and 18 years or older for females.
• Legal Capacity: You represent and warrant that you are legally competent to contract under the Indian Contract Act, 1872, and have not been prohibited or restricted by any law, court order, or law enforcement agency from entering into a matrimonial alliance or using matchmaking services.
• Consent & Free Will: You register and login on the website/app entirely of your own free will, choice, and consent. The Platform has no involvement or role in your personal decision to register. You share your personal data and profile details of your own free will and choice, and you are solely responsible for your own data. You can delete your profile at any time. You cannot hold the Platform, its proprietor, or operators responsible, nor can you legally challenge the Platform at any time for your registration and sharing of data.

2. Account Registration, Verification & Security

• WhatsApp OTP Verification & Mobile Mandate: Access to the platform requires authentication. To verify your identity, you must provide a valid Indian mobile number. Registration is authenticated strictly via a One-Time Password (OTP) sent via WhatsApp (utilizing third-party APIs and server-side verification). The use of virtual numbers, VOIP, or temporary SIMs is strictly prohibited. Mobile verification is mandatory to interact with or contact other members on the Platform; profiles without verified mobile numbers will not be allowed to proceed.
• No Biometric Processing: NavuMilan does not collect, process, or store device-level biometric data (such as fingerprints or facial scans) on its servers.
• Single Profile Policy & Duplicate Accounts: You are permitted to register and maintain only one (1) active profile on the Platform. Duplicate profiles, fake accounts, or impersonation of other individuals will result in immediate and permanent termination of all associated profiles. The Platform reserves the right to cancel all duplicate or suspicious profiles without warning and without any reimbursement of subscription costs or fees. Terminated or suspended accounts due to violations of these terms or our code of conduct are strictly not eligible for any refund of subscription costs, tokens, or fees.
• Profile Creation Consent & Impersonation: You certify that the content and information submitted by you, including personal information, are true, correct, and accurate. If you are creating a profile on behalf of a relative, sibling, friend, or ward, you confirm and warrant that you have obtained the necessary explicit consent from the individual whose profile you are creating on the Platform. Impersonation, misrepresentation, or unauthorized profile creation is a severe crime penalized under Section 66D of the Information Technology Act, 2000, and other relevant criminal laws in India.
• Verification Recommendation & Document Authenticity Disclaimer: To build trust in the community, it is strongly recommended that you upload a copy of your Aadhaar Card, Caste Certificate, or other government-issued identification, as well as get a trust/verification badge on your profile. The Platform acts merely as a repository and does not assume liability or responsibility for the originality, validity, or legal authenticity of the documents or photocopies of IDs provided by any member. We do not verify credentials of any member such as family status, educational qualifications, financial status, occupation, character, etc.
• Confidentiality: You are solely responsible for maintaining the confidentiality of your device and login credentials. You agree to accept liability for all activities occurring under your account.

3. Data Segmentation & "Privacy Lock"

To protect your privacy, NavuMilan implements a strict database and UI-level segmentation:

• Public Profile Data: Basic profile fields including Name, Age, Birth Year, Gender, Height, Weight, Diet, City, Taluka, Annual Income, Religion, Caste, Sub-caste, and Profile Photo (if public visibility is enabled) are visible to registered users.
• Private Profile Data: Highly sensitive details - specifically your Mobile Number, Date of Birth, Profile Photo (Controlled), Family Names, Native and Mosad, College Name, and Company Name - are protected by our proprietary "Privacy Lock" mechanism.
• Mutual Connection Enforced Access: As enforced at the database layer (via database rules), your Private Profile Data is strictly encrypted or masked. It is only revealed to another user after a Mutual Match is established (meaning you have sent an interest request, and the other user has accepted it, or vice versa).
• Offline Share Disclaimer: Once a Mutual Match is established and your masked data is revealed, the platform has no control over how the receiving user utilizes that information. You acknowledge that you share details at your own discretion and risk.

4. Automated Document Generation (Bio-Data PDF)

• On-Device PDF Generation: The App provides an automated utility that compiles your profile details and generates a localized Matrimonial Bio-Data PDF for sharing.
• User Responsibility & Shared Links: The generated PDF contains a deep-link routing back to your profile.
• Export and Distribution Disclaimer: Once you download, export, or share the Bio-Data PDF outside the App (e.g., via WhatsApp, email, or physical print), MUKM CENTRE has zero control, responsibility, or liability over the security, integrity, or distribution of that document. You agree that any misuse, altering, unauthorized forwarding, or leak of the PDF by you or third parties is entirely your liability.

5. Platform Integrity & Prohibited Activities

You agree that you will not, under any circumstances, engage in the following:

• Screenshots & Screen Recording: We employ OS-level security measures to block screenshots and screen recordings of other users' profile pages within the Android application. Bypassing or attempting to bypass this protection via emulators, rooting, external capture hardware, cameras, or third-party modifications is a direct and material breach of this Agreement.
• Automated Scraping & API Abuse: Using automated scripts, scrapers, bots, or spiders to access, harvest, crawl, or download user data or profiles is strictly prohibited. The platform employs strict rate-limiting. Bypassing or attempting to bypass these rate limits is a violation of contract and a cybersecurity offence.
• Profile Sharing & Consent: While the Platform allows you to share another user's official profile deep-link (which reveals only minimal, public details), copying, posting, or distributing any user's private profile information, photos, or complete profile details outside the Platform without their explicit consent is strictly prohibited. You are only permitted to share the official profile link.
• Harassment and Commercial Use: You shall not use the platform to solicit users for commercial purposes, prostitution, dating, escort services, financial transactions, or spam. Any form of abuse, harassment, obscene language, or defamatory content will result in immediate termination and reporting to authorities.
• Commercial Solicitation, Chain Letters & Spam: You may not advertise to, or solicit other Members to buy or sell any items or services using the Service, save for the sole purpose of promoting/advertising your own profile for matching reasons. You will not send any chain letters, mass emails, spam, or junk mails to other members.
• Prohibition of Competitor Information: You will not post or transmit any content, profile details, or information that contains details or particulars of any competitors of NavuMilan, including their contact details, websites, or promotional material.
• Daily Fair-Usage and Interaction Limits: To maintain platform security and prevent data harvesting, there is a strict limit on the number of profiles you are allowed to view or contact each day. You cannot contact or send interest requests to more than 100 profiles in a single 24-hour period. Bypassing this limit using scripts or multiple accounts is a violation of this Agreement.

6. Role as an Intermediary, Law Enforcement & Disclaimers

• IT Act Intermediary Status & As-Is Platform: NavuMilan (operated by MUKM CENTRE) acts strictly as an "Intermediary" as defined under Section 2(w) of the Information Technology Act, 2000. The Platform and all features are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in the transmission.
• No Background Verification & Precautionary Efforts: All profile data is self-reported by the users. We attempt to take certain reasonable precautions to offer a genuine, clean, and meaningful database; however, the organization (MUKM CENTRE), NavuMilan, its proprietor, developers, employees, and agents do not accept any legal responsibility, liability, or risk originating from wrong, false, or inaccurate data presented by any of the member(s). We do not conduct background checks, forensic investigations, police verification, credit checks, or character screenings of any user. We do not verify credentials of any member such as family status, educational qualifications, financial status, occupation, character, or the authenticity of physical home/office addresses listed. The duty of due diligence lies solely on you. You must independently verify the character, family details, caste, marital status, employment claims, address validity, and all other credentials of any user/match before meeting or finalizing marriage plans.
• No Address Authenticity Guarantees: We do not verify, claim, or warrant the authenticity or ownership of any physical home or office addresses listed on profiles or scheduled for meetups. Members must satisfy themselves through adequate efforts, initiatives, and due diligence.
• Extraneous Content and User Behavior: We hereby alert and warn all members of the possibility of unauthorized posting of content by any person, including members and unauthorized users. We advise discretion in access since such content, information, or representation may not be suitable or may be offensive. We are not responsible in any way for such content, nor are we liable for any alterations, modifications, deletion, reproduction, sale, transmission, or misuse of data and content in the public domain by any user.
• Cyber Security & Data Theft Disclaimer: We respect everyone's privacy and desire for data security. However, in this digital world, we cannot provide an absolute guarantee of data security on our platform. The data can be stolen and App/Website can be hacked or compromised by hackers. Therefore, every user who interacts on our Platform using sign up, login, chat, or offline meetups does so at their own sole risk. We assume no liability or responsibility for unauthorized data access, hacking, or security breaches.
• Virus/Malware Disclaimer: We do not warrant that this Site, Applications, its servers, or electronic communications sent from us are free of viruses, malware, or other harmful components. We will not be liable for any damages of any kind arising from the use of the platform.
• Cooperation with Investigation Agencies: On being expressly ordered by competent statutory authorities, NavuMilan shall attempt to offer all feasible help, data logs, and cooperation to the police (Cyber Crime Investigation Cell) or any other statutory investigation agency in combating or prosecuting fraudulent users. You can write to us with all the specifics of your case to report fraud or misuse.
• Match Scores Disclaimer: Compatibility percentages ("Match Scores") are generated client-side by basic algorithms based on user-entered preferences (Age, Location, Diet, Education). These scores are purely informational and do not represent a guarantee of compatibility, marriage success, or endorsement of any profile by the platform. We are not responsible or liable for any decisions, actions, or matchmaking outcomes based on these automated calculations.

7. Member Disputes & Interaction with Other Members

• Inter-Member Responsibility: You are completely and solely responsible for your advertisements, communication, and discussions/meetings with other members of the Platform.
• Monitoring of Disputes: The Platform maintains the right to monitor disagreements or disputes between you and other Members, but it is under no duty or obligation to do so. In addition, the Platform maintains the right to take necessary measures (including account suspension or termination) against disobedient, harassing, or violating members.
• No Obligation to Disclose: The Platform is not obligated to disclose information, logs, or complaint reports concerning other members with anyone, including complainants, unless legally ordered by a competent court of law or law enforcement agency.
• Disclaimer of Duty/Liability: The Platform explicitly disclaims any and all duty or liability for any inter-member transactions, interactions, financial dealings, or offline match outcomes.

8. Payments & Billing

• Third-Party Payment Processors: Payments for premium packages or subscriptions are processed via authorized third-party payment gateways. We do not store credit card numbers, CVVs, or internet banking credentials.
• Non-Refundability: All premium purchases, tokens, or subscriptions made on NavuMilan are strictly final, non-cancellable, and non-refundable under any circumstances, unless mandated by statutory laws.

9. Limitation of Liability

10. Absolute Indemnity

You agree to protect, defend, indemnify, and hold harmless MUKM CENTRE, its proprietor, affiliates, developers, and representatives from and against any and all claims, lawsuits, disputes, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• Your breach of this Agreement or violation of any applicable laws.
• Any fraudulent, incorrect, or misleading profile details uploaded by you.
• Your misuse of the Platform, including bypassing screenshot restrictions, scraping, or harassing other members.
• Claims filed by third parties or other users resulting from your interactions or behavior off-line.

11. Governing Law, Dispute Resolution & Arbitration

• Governing Law: This Agreement, the interpretation thereof, and any disputes arising out of your relationship with the Platform shall be governed strictly by the laws of India, without reference to conflict of laws principles.
• Mandatory Mediation/Negotiation: In the event of any dispute, claim, or controversy, both parties agree to first attempt to resolve the issue amicably through mutual negotiations and discussion.
• Binding Arbitration: If amicable settlement is not reached within thirty (30) days, the dispute shall be referred to and resolved by binding sole-arbitrator arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of the arbitration shall be Vadodara, Gujarat, India. The language of the arbitration shall be English or Gujarati. The award passed by the arbitrator shall be final, binding, and executable on both parties.
• Exclusive Jurisdiction: Subject to the arbitration clause above, both parties agree to submit to the exclusive jurisdiction of the competent courts located in Vadodara, Gujarat, India to resolve any legal disputes.

12. Intellectual Property Rights

• Proprietary Ownership: All rights, titles, and interests in the NavuMilan application, including its source code, database architecture, UI/UX designs, logo, matching algorithms, structured Display ID generation schemes, and technical documentation are the exclusive intellectual property of MUKM CENTRE.
• License to User Content: By uploading photos, bio-data, and profile details, you grant us a non-exclusive, worldwide, royalty-free license to host, display, translate, and process this data for the sole purpose of providing matchmaking services to you.

13. Account Termination & Data Archival

• Voluntary Deletion: You can request the permanent deletion of your account at any time via the in-app settings.
• Data Erasure: Upon deletion, all your active profile details will be permanently erased from the live database.
• Compliance Retention (Deletion Log): In strict compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) of India, Information Technology Rules, 2021, and CERT-In guidelines, we retain a minimal Deletion Audit Log for a mandatory period of 180 days post-deletion. This log is write-only, encrypted, and automatically deleted after 180 days.
